Copyright troubles for Jang Nara

According to the Seoul Central District Court, the Korea Music Copyright Association received a request from an American songwriter that sales be stopped for Jang Nara’s sixth album “Dream of Asia.” She’s charged with infringing on copyright by recording a song without permission, “Mirage” [신기루], for which she also recorded its English version, “If You Ask Me To” (listen below).

The written application states: “The producers used the song on the sixth album without consent of the copyright holders, and the American songwriter has clearly stated never giving permission… This is a clear act of copyright infringement.” The application demanded that the album be pulled from online music services, and the recording cease production and sales.

Bad Korea! We all know you rip off artists all the time, but now you’re finally starting to get called on it legally. First Hyori, now this? Maybe kpop would be better if you started writing your own songs. (Then again, maybe not.)

totally pisses me off- i love jang nara and it makes me mad that the korean producers cause her these troubles. It gives a bad image to the singer because it's usually the singer that gets the blame and not the producers or songwriters. And then the singer's time in recording and preparing for the album is wasted. I'm surprised they went and produced the song without buying the rights-you'd think they'd learn after hearing about the Hyori debacle.

Yeah, I highly doubt this is her fault. She probably just sings what the producer tells her too... besides can't they call it "sampling" :)

She prob doesnt even know that it belonged to someone else...
I mean, i live in US and i never heard of this song br.......but on the other hand...she might have known....

and ppl...give the girl some credit! Her english wasn't that bad! it was understandable!! which is a one-up from Lee Dae Hae's I Love Rock and Roll debacle hahahahah

agreed, jang nara probably didn't know or realize this would be an issue. i guess with the rising popularity in korean music, more singers won't be slipping below the radar anymore. at least plagiarism isn't as common as it was, say, 10 years ago.

i have no idea how sampling works in the legal arena but many wonderful groups, like epik high, seem to do this with, thankfully, no major consequences. any lawyers who can clear this up?

her accent is probably not the only reason the korean version sounds better. i'm no linguist but i once learned that the korean language uses fuller vowels and less "hard" consonants (unlike germanic languages) sort of like the romance languages so they sound more musical. i'm probably vastly oversimplifying this, however.

Or didn't he own the copyright to the song after all as it seems from the above news report?
Or maybe it the other person he wrote the song with that making the fuss?

And yes her english singing of the song makes her sound as if she has a lisp, the trouble a lot a Asians have with hard consonants though she sounded kind of cute. She was certainly more than fine in Fairy Tale from Dream of Asia but that was likely done in a studio I never heard her try and sing it live.
I can not see how Jang Nara, other than at the bottom line as Jang corp is a family biz I guess, how she can be held personally to blame if Shedrick Mitchell can be sitting next to her at news shows and playing the piano for her when performing the song. It can only be trouble from the usa end.
Either Shedrick Mitchell did not own the copyright to the song wasn't the sole owner or he wasn't paid for the song in some manner

Too Bad..I love Jang Na Ra

Looking at the youtube;s video when Shedrick Mithchell appear with Jang Na Ra on his recent visited, it proven that she didnt copycat but maybe the other hell ya person whom Shedrick Mithchell work has some problem.

It s too BAD when netizens and Hyori fans was like defending her from copy the hell cat others piece.

I'm waiting more lawsuit to HYORI. She is like a queen of copycat.

I find the way the english video was shot is disconcerting. Why did they make up the "romance" between them? The way they elongate the conversation they have in the studio, making it look like they're looking longingly at each other. [Betcha he was correcting her english: she sticks out her tongue in frustration] And then when he gets in the car and she swipes at her nose. Crying or sneeze? Sigh.

Or are they really a couple?

the romance lol no do not think so it likely more of a teacher student thing they where putting across, still doesn't cover why the lawsuit. Still I see Jang Nara got a new endorsement deal , it looks like so the $ still rolling in..lol

Well it seems a storm in the tea cup as the album was released in china end of last year. Like all these things people are quick to point the finger but no one puts any retraction up, that doesn't make good headlines.

Shedrick Mitchell co-wrote the song with Jennifer Hamady, but she's the sole owner of the publishing on it. The song was a finalist in the 2007 American Idol songwriting contest for the coronation single (the song lost to “This Is My Now”).
